The Office of the Director of Public Prosecution (ODPP) has confirmed that former Baringo Central MP Sammy Mwaita has been charged with land fraud, over his involvement in a scheme to grab land worth Ksh150 million along Mai Mahiu Road in Nairobi West.   In a statement on Monday, August 4, the ODPP said that the prosecutor charged Mwaita, who was arraigned at the Milimani Law Courts, with unlawfully fabricating two title deeds to defraud individuals of the two prime lands 24 years ago.   According to the ODPP, Mwaita, who has also served as a land commissioner, used the forged title deeds to register the two pieces of land without the knowledge of the original owners.   According to the court, in 2020, Mwaita also misled the Directorate of Criminal Investigations (DCI) by claiming that the two parcels of land belonged to another entity.

According to ODPP, the former MP used this strategy with the intent of recommending criminal charges against the rightful owners of the lands.

Former Baringo Central Member of Parliament Sammy Mwaita Photo Mzalendo The court has further charged the former MP with conspiracy to commit a felony, making a document without authority, abuse of office, and two further counts of giving false information to public officers.   "Prosecution told the court Mwaita and his co-accused, Brian Kiptoo Kiplangat, conspired on or before March 30, 2001, to fraudulently generate title documents for Grant Title without legal authority," ODPP stated.    "Prosecution further revealed that Mwaita, while serving in public office, fraudulently registered both Plot "A" and an adjacent parcel identified as Plot "B", without the consent or knowledge of their respective owners," ODPP stated.   Mwaita has been released Mwaita and his co-accused were released on a bond of Ksh10 million or an alternative cash bail of Ksh2 million, with two sureties, after they pleaded not guilty to the charges.   "Mwaita's co-accused, Kiplangat, failed to appear for plea-taking, prompting Senior Principal Magistrate Ben Mark Ekhubi to issue a summons for his appearance on Tuesday," ODPP stated.    Detectives apprehended the former MP alongside his accomplice on Sunday, August 3.
